What should you do when a product you’ve purchased causes serious injury? Does the product itself have serious design flaws, or was something about the product overlooked during safety testing?

These are the questions asked by people who have been injured because of faulty products. The answers, however, may not be so easy to uncover. In some cases, the manufacturer may have sold the product to the public without knowing there was a problem. In some cases, greed replaces ethics, and manufacturers rush to sell the product before its safety can be verified, placing millions of people, including children, in harm’s way.

Why Product Defects Occur

All products manufactured for use by humans must comply with safety standards and packaging and labeling requirements. But passing these basic requirements does not automatically certify a product as safe. Sometimes, safety standards are ignored to generate higher profits. Other times, a manufacturing malfunction may have caused the defect. Regardless of the intent of the manufacturer, liability for the injuries of others is a serious matter and manufacturers of defective products should be held accountable.

A product defect might be caused during the design phase or during the manufacturing phase. Products with manufacturing defects will vary in some way from other models manufactured by the company. Products with defects in design will look just like all the other products, with no obvious differences, because the flaw is in the design.

What To Do If You Are Injured

If you are a loved one has been injured by a defective product, what should you do? Some attempt to contact the manufacturer directly. But, as a lone consumer, this may not be the most effective way to get help. Who exactly do you speak to at the company? How do you know you’ve reached the right person? What will the company offer for your injury, not to mention potential lost wages, medical bills and pain and suffering? Some companies will simply offer to replace the product. This is hardly adequate in the face of serious injury.

The best way to approach the situation is by hiring an experienced defective product lawyer. Representation through an attorney sends a message that you are serious about the effects of your injury and its consequences, and you intend to hold the manufacturer responsible for their negligence. An attorney skilled in handling defective product cases knows how to use the proper channels to bring your injury to the attention of the manufacturer’s corporate personnel and let them know they may be facing a lawsuit.

Recovering Damages

Depending on the extent of your injuries, the type of defect, and the nature of the product, your attorney’s goal is to obtain compensation for your injuries to cover:

· Compensation for treatment expenses

· Property damage

· Lost income

· Pain and suffering

· Other consequences

Remember: It is your right to assume your personal safety when purchasing the manufacturer’s products. Manufacturers who fail to meet this duty may be putting their company at risk for product liability lawsuits.

Is it safe to use a humidifier brand that has been recalled before?

Question by needhelp: Is it safe to use a humidifier brand that has been recalled before?

I’m interested to buy a humidifier called: Hunter Care-free warm mist humidifier. This specific product has been recalled due to potential fire hazard. There are 4 reports from consumers of minor property damage from water leaking to the electrical components causing fire. Accordingto the website below, the recall is for products sold at stores nationwide from September 2005 through February 2006.

it’s 2007 now and I still see the product being sold at target.com, iallergy.com and several others. Does it mean that they have corrected the problem and is it safe to buy those products now? Or are these retailers trying to sell leftover products that still have the problem?

Call the manurfacturer & ask which model was recalled & then dont use that one.

Question by Flora: Veterinary: A design flaw in horse hind limb anatomy skeleton?

There is a life-size and real bones skeletal model of a horse’s right hind limb in my college Veterinary Anatomy Lab class. It was made by Carolina Biological Supply Company years ago. There is a design flaw in this model. Does anyone happen to know what the design flaw is please?
Perhaps someone is familiar with this particular model.

Portal Design (4) Box delivery system malfunction

Sorry, I was listening to radio while testing my map. Well, I got to make a new sketch about the multi-box delivery system that, as you can see, doesn’t work. At all. In Portal, the delivery system only delivers ONE box. Mine is supposed to deliver multiple. That’s why it’s hard.

We purchased a Mia Moda Viva Supreme infant car seat for our son in April 2009. He was born in July 2009. The seat was recalled in October 2009 due to a metal harness splitter plate on the back of the car seat that has sharp edges that can cut the harness and the stay-in-car base can crack during a crash. I filled out the product registration card when we purchased it and mailed it back to them, I think I may have even registered it online. I did not receive any notification about this recall at all. I went on the website today to look for a new stroller and found the recall information! I was so mad that my son has been riding in this seat for the last 8 months and I never knew that it was unsafe!
Have you ever had a car seat recalled? Did you get a notification from the manufacturer? Isn’t that what the product registration cards are for, to inform the consumer about recalls and product updates? If not, what are they for? Why do I waste my time filling them out if they are not going to notify me of something like this?

The reason we purchased this seat over others was due to it’s high safety ratings! How ironic!
On their website you have to input your seat’s serial numbers and manufacture date and then they determine if your seat is eligible for reimbursement. If it is then they send out a “return kit” in which you must cut out the seat belt and send it to them and they will send reimbursement when they receive it back.

I had two car seats that were recalled. (Same seat) I received a repair kit and fixed the seats myself…..very simple. Call the company and request a repair kit. Next time you get a new product you can call and register your purchase. This way you KNOW they have your info in case of a recall or something.

Their market is fiercely patriotic and does not deal well with design changes much less vegetarian curry.

yes I think it was. Harley riders that are for the most part patriotic and will not buy a bike made in India. That is, if they know. They will probably start buying Indian and Victory Motorcycles.
