Some 36,000 Chinese-made children’s storage racks sold at Wal-Mart Stores Inc (WMT.N) in the United States were recalled after a baby was suffocated by an overturned rack, the U.S. Consumer Product Safety Commission said on Friday.
The wooden storage rack, manufactured for Irving, Texas-based Jetmax International Ltd, has three levels and nine removable canvas totes, the safety agency said. One model has red, blue, yellow and green canvas totes, and another model has pastel-colored canvas totes.
An 8-month-old boy suffocated after he pulled on a storage rack and it fell over on him, with the top rail landing on his neck, the government agency said.
Wal-Mart sold the storage rack organizers under the brand “Home Trend Kids” from August 2004 through July 2005 for about , the agency said. The product was also sold at Ollie’s stores from July 2006 through June 2007.
Consumers should immediately stop children from using the recalled storage racks and contact Jetmax International to receive a free repair kit that adds stability to the base of the rack, the agency said.

With the recent recall of peanut related products, I am left wondering what would happen to a business that continued to sell the contaminated product? Do you think there should be laws with potential fines or jail time for shop owners who continue to sell these products?
In example: there is a small corner store in my town just outside Baltimore City. The shop owner is strange and I doubt he is aware that there are recalls on peanut related products and if he does know about the recall I highly doubt that he would throw away any of his merch. I also don’t think he gets his stuff from a distributor, more like a Costco shopper. I still see peanut butter crackers, sports bars etc… on his shelves. if this makes someone sick they could die. Sol what I want to know is, Is it the consumers responsibility or should the retailer be held responsible for selling recalled product?

My son and his girlfriend were burned alive, due to the failure of the recalled cruise control switch. My car was NOT RECALLED until 7 months after they were killed. I have filed a wrongful death suit, Ford knew this part was defective since the early 90’s and still let people drive them around with ticking time bombs under the hood. So if you would like to be a witness let me know with a e-mail address.

theres a class action lawsuit active on this- look it up on the web-we had a ford police car here in bolivar that burnt to the ground years back because of it-a 1996 crown vic-cop model

Get a lawyer. It will be too much trouble to wade through the legal quagmire otherwise. But only do so if the injury was substantial and it can be linked to the product’s defect.

Oh yes…by selling a recalled product they have to pay for any damages………….and then some based on how you go at it.
It was recalled for a reason….it’s the store’s responsibility to get it off their shelves.

Menu Foods recalled 46 brands of dog food and 37 brands of cat food including Iams, Nutro and Eukanuba. The company has not released the product numbers.
The website only lists the names. It does not have the product numbers.

The government wouldn’t stop Pepsi to be produced, sold, and consumed. With today’s technology, they would know what caused this mutating skin cancer and take that one part out of Pepsi. The workers would all keep about their work.
Every heard of Aqua Dots? They were “creative” toys for kids. A bunch of dots that kids would put together and when you poured water on them, they came together to make your shape into one item instead of a bunch of dots. We came to find out that when swallowed and combined with the contents of a child’s stomach, the Aqua Dots turned into a date rape drug. They were completely recalled and taken off the market for good.
What happened?
The company made new Aqua Dots that didn’t make kids pass out for hours to wake up with a killer hangover.
Long story short, The company would just remake their product.

2 days ago he discovered that he could lean over the side of it and got stuck and today when i was feeding him in it he kept leaning forward and i kept having to push him back and it was pretty dangerous and i would never leave him unattended in it the only thing i have used it for since he got stuck was for his feedings because we do not have a highchair and i just ordered one and it should be here by tomorrow but in the mean time i am using the swing only for feedings…he is 6 months old and i know he has now out grown it but do you think i should call and try to see if i can get my money back…by the way if you look at the link it says “Sold at: Discount department stores and toy stores nationwide from November 2006 to May 2007 for about .” and i bought it December 2008 should i try or leave it alone?

I had 2 things that were recalled.My Simplicity Bassinet and my Crib,I just called Simplicity and they sent me a check for both items I had,
Your sons swing may not have been recalled,I know when my stuff was recalled they had to match the numbers with the dates that they were manufactured I mean the only way you will know for certainty is if you call Fisher Price.
