I asked a question earlier about this regarding my foot warmer which burned through everything. I have just learned that the product was recalled BEFORE they sold the product!

Oh yes…by selling a recalled product they have to pay for any damages………….and then some based on how you go at it.
It was recalled for a reason….it’s the store’s responsibility to get it off their shelves.

There is also something called consumer responsibility which means that you are also to be on the look out for these recalls. If a retailer sells a product after the recall it’s still not the fault of the retailer that the product is bad. In most states including mine it’s rather simple; buyer beware.
Also to prove the damage, find an attorney willing to take it and reap a civil judgment of monetary compensation is very unlikely as not any life or health has been damaged.
Call the manufacturer and state you purchased their recalled product after the recall from the retailer. You better have proof of purchase to include product, price, date and retailer. You many be offered a replacement product or your money refunded by the manufacturer but that will be the extent of it all.
yes they have the responsibility, but see if you can collect on it. Many times the phone line is always busy, or you can’t get an answer on it. Go to State attorney’s office if you wannt to file a complaint about a company. they are proficient and very helpful.lol
Sometimes its the retailer that fails to pull the product from the shelves even after the manufacturer has recalled it. So it could be the retailer’s fault.
